By adopting a tree or placing an order with My Fruit Tree, you acknowledge and agree to the terms below.
1. The Nature of Our Business
My Fruit Tree operates a living, working organic citrus grove in Lake County, Florida. We sell tree adoptions and fresh agricultural produce. By its very nature, farming involves variables that no business — no matter how experienced or careful — can fully control. Weather, drought, frost, flooding, wind, pests, disease, and the unpredictable rhythms of the natural world are all part of growing food. We farm with organic certification, deep expertise, and genuine care. We do not farm with guarantees. This is farm business. We ask that you purchase with that understanding.
2. Tree Adoptions
All Sales Are Final All tree adoption subscriptions are non-refundable. When you adopt a tree, you are purchasing ongoing access to a named, living tree and the suite of services that come with it — including enrollment, plaque installation, dashboard activation, quarterly updates, and grove events. These services begin at the time of adoption. For this reason, no refunds will be issued after purchase, regardless of when the request is made.
No Refunds on Tree Adoptions
Tree adoption purchases — at any subscription tier — are final. No refunds, partial refunds, or credits will be issued due to change of mind, inactivity, or subscriber cancellation after purchase.
3. Trees Are Living Things
No Guarantees Citrus trees, like all living organisms, can become diseased, stressed, damaged, or fail. Causes include but are not limited to: frost, freeze events, drought, flooding, hurricane damage, citrus greening (HLB), root disease, pest infestation, lightning, and other acts of nature.
My Fruit Tree makes no warranty — express or implied — that any individual tree will survive, thrive, or produce fruit at any specific time or in any specific quantity. Projected harvest yields are estimates only and are not guaranteed.
Tree Replacement
Our Commitment While we cannot guarantee the survival of any individual tree, we are committed to the long-term success of every adoption. In the event that your named tree does not survive due to circumstances within our reasonable control, we will make every reasonable effort to reassign you a comparable replacement tree and continue your subscription without interruption.
We reserve the right to determine what constitutes a comparable replacement tree and what circumstances fall within or outside of our reasonable control. Replacement trees are provided as a goodwill gesture and do not constitute a contractual obligation or entitlement to any refund.
Acts of God, weather events, disease outbreaks, and other natural causes are explicitly excluded from replacement eligibility and do not entitle the subscriber to any refund, credit, or compensation.
4. Fruit Deliveries
Perishable Goods Fresh grapefruit and all other perishable agricultural products shipped by My Fruit Tree are non-returnable and non-refundable. We do not accept returns of perishable goods under any circumstances.
Fruit is a perishable, natural product. Color, size, weight, and flavor will vary from shipment to shipment and tree to tree. Variation in appearance or taste is not a basis for a refund or replacement.
No Returns on Perishable Goods
All fruit, juice, and perishable farm products are sold as-is and are final sale. No returns, exchanges, or refunds will be issued once perishable goods have been shipped.
Damaged Shipments
If your fruit shipment arrives with clear evidence of carrier damage — meaning damage caused during transit that was not the result of natural produce variation — you must notify us within 48 hours of delivery with photographic evidence. We will review each report on a case-by-case basis and may, at our sole discretion, offer a partial credit toward a future shipment.
We are not responsible for delays, loss, or damage caused by the shipping carrier once a package has been accepted by the carrier. Delivery estimates are not guaranteed.
5. Subscription Cancellations
Subscribers may cancel their subscription at any time through their account dashboard or by contacting us directly. Cancellation stops future billing immediately.
Cancellation does not entitle the subscriber to a refund of any amounts already billed. If you cancel mid-billing period, you retain access to your subscription benefits through the end of that paid period. No pro-rated refunds are issued.
Harvest shipments are prepared and shipped on a seasonal schedule. If a harvest shipment is already in preparation or has been dispatched at the time of cancellation, it will be fulfilled and billed as scheduled. No refund will be issued for a harvest shipment that is in progress at the time of cancellation.
6. Non-Perishable Merchandise
Non-perishable merchandise (apparel, gift cards, grove products) may be eligible for exchange or store credit within 14 days of delivery, provided the item is unused, in original condition, and accompanied by proof of purchase. We do not offer cash refunds on merchandise.
Gift cards and digital products are non-refundable.
7. Exceptions
Errors on Our Part If you receive the wrong item, or if we make a verifiable fulfillment error, we will correct it at no cost to you. Please contact us within 5 business days of delivery with your order details and a description of the issue.
My Fruit Tree reserves the right to make the final determination on all refund, exchange, and replacement requests. Our decision is final.
